POSH Act 2013

Key Provisions of POSH Act 2013

The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 defines clear obligations for employers, rights for employees, and consequences for perpetrators.

Definition of Sexual Harassment
Includes any unwelcome act of physical contact, demand/request for sexual favours, making sexually coloured remarks, showing pornography, or any other physical, verbal or non-verbal conduct of a sexual nature.
Employer's Obligations
Every employer must constitute an Internal Committee (IC), provide a safe working environment, display penalty information at conspicuous places, organise awareness programs, and monitor complaint redressal.
Rights of Aggrieved Women
Any woman employee/student can file a complaint within 3 months of the incident. The IC must complete inquiry within 90 days. Interim relief including transfer or leave may be granted during inquiry.
Confidentiality
The contents of the complaint, identity of the complainant, respondent, witnesses, and the proceedings are strictly confidential. Disclosure attracts a penalty of ₹5,000 under the Act.
Consequences for Perpetrators
Based on the inquiry report, the IC may recommend disciplinary action including written apology, warning, demotion, withholding of promotion, termination, or undergo counselling.
False Complaints
Filing a false complaint or providing false evidence is also an offence under the Act. However, a complaint not proved does NOT automatically mean it was false — burden of proof is on the respondent.
How to Complain

Complaint Procedure

Follow these steps to file a complaint with the Internal Committee.

File Written Complaint
Submit a written complaint with six copies to the IC Chairperson within 3 months of the incident (extendable by 3 more months for valid reason).

Complaint Acknowledgement
The IC will acknowledge receipt within 7 days and may attempt conciliation if requested by the complainant (no monetary settlement allowed).

Inquiry Initiated
The IC conducts a formal inquiry following principles of natural justice. Both parties have the right to present evidence and witnesses.

Inquiry Completed
Inquiry must be completed within 90 days. Interim relief may be granted (transfer, special leave up to 3 months) during inquiry period.

Action Taken
The IC submits report to the employer with recommendations. Employer implements action within 60 days of receiving the report.
